General Terms and Conditions of Sale
The terms and conditions of sale are subject to Italian law, which is expressly referred to in Art. 15 of the following regulations.

Art.1 Parties
Seller: the company Eurotelitalia Srl, with headquarters in Via Giacomo Leopardi, 4 - 03043 Cassino (FR) - Italy - P.IVA/C.F. 02865430603, REA: FR 183209,(hereinafter referred to as Seller). C
Customer: the person identified by the data entered upon registration and acceptance of these general conditions(hereinafter referred to as Customer).
The following General Terms and Conditions of Sale form an integral part of all our contracts for the supply of materials, even when orders are taken by telephone, verbally, by fax, e-mail or Internet.

Art.2 Object of the service
Through the online sales contract, the Seller provides the Customer with a virtual store from which it is possible to view and purchase its products. Eurotelitalia Srl disclaims any liability regarding the possibility that, due to a particular configuration of the Customer's computer or a, even temporary, malfunction, the colors of the products photographed or the features displayed and described on the site, may be different from the originals. The photos on the site are purely indicative (before purchasing particular "technical" products, we advise the Customer to contact us to check their size, color or other relevant details). The Seller informs that it is possible to enter the site https://www.eurotelitaliasrl.it/ without being a registered user and access the information, electronic catalog, product sheets, basic price list and all those services that do not require personal data to be used. In order to place a purchase order on this Site, you must: - be 18 years of age or older; - be able to legally enter into binding contracts; - have a valid e-mail address.

Art.3 Acceptance of the General Terms and Conditions of Sale
All contracts will be concluded directly by accessing the corresponding website at https://www.eurotelitaliasrl.it where the customer can conclude the contract for the purchase of the desired product by carefully following the instructions and procedures provided. The preceding general sales conditions are an integral and essential part of the sales contract, which is why they must be examined "on-line" by the Customer before completing the purchase procedure. Submission of the order confirmation therefore implies full knowledge of them and their full acceptance. The general terms and conditions of sale may be updated or modified at any time by https://www.eurotelitaliasrl.it/, which will communicate this through the pages of the website. The Customer, by sending electronic confirmation of his/her purchase order, unconditionally accepts and undertakes to observe, in his/her relations with https://www.eurotelitaliasrl.it, the general conditions of sale, including the payment conditions illustrated below, declaring that he/she has read and accepted all the information provided. The purchase contract is finalised by means of the exact completion and consent to the purchase manifested through the adhesion given "on-line", subject to the successful completion of the payment.

Art.4 Request for quotation
Any request for quotation sent by email does not constitute a purchase order. Eurotelitalia Srl will only provide information covered by such requests.

Art.5 Payment The Customer may choose between the following payment methods: 1. Credit card via SSL. 2. Advance bank transfer. 3. Cash on delivery up to € 800.00 including shipping costs (cash on delivery surcharge € 5.00 per shipment). The Seller shall not be liable for inefficiencies due to force majeure such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the agreed time frame. The Seller shall not be liable to any party or third party for damages, losses and costs incurred as a result of the non-execution of the contract due to the aforementioned causes, the Customer being entitled only to a refund of the price paid. The Seller shall not be liable for any fraudulent and unlawful use that may be made by third parties of credit cards or other means of payment, when paying for products purchased.

  1. Payment by credit cards
    When payment is made by credit card, Eurotelitalia Srl, uses the SSL payment system. When confirming the order, the customer is directed to the secure server (SSL) of the bank where he will be asked to enter his credit card details. Your credit card details are used, via a secure connection in SSL (Secure Socket Layer) encryption, for the authorisation provided by the card provider. This procedure is absolutely secure and fully guarantees both the customer and Eurotelitalia Srl. The SSL encryption system guarantees that no one can in any way read the information sent over the Internet.
  2. Bank transfer
    Payment by bank transfer is subject to the following conditions: the bank transfer must be received within 5 working days of placing the order. After this date the order will be considered null and void. The reason for payment on the bank transfer must indicate: the number and date of the order, the company name or the name of the purchaser; the coordinates are visible on the site during the order procedure and are also shown in the order confirmation email sent automatically to the customer. It is understood that, if a bank transfer is chosen, the goods will only be shipped once the crediting to our bank account has been verified. With the exception of instant bank transfers, which provide for real-time crediting, however, some banks do not have this method and the credited amount is credited to the beneficiary's bank account no earlier than 1-3 working days from the date of the transfer.

Art.6 Product Availability and Delivery
Products purchased on www.eurotelitaliasrl.it are delivered throughout Italy. The products purchased will be delivered by express courier, accredited carriers and by Eurotelitalia Srl's own means, to the address indicated by the Customer as the destination address. Any claims for damage or tampering with the goods during transport must imperatively be contested to the carrier at the time of delivery, failing which Eurotelitalia Srl shall not be liable for any apparently detectable damage. At the time of delivery, the customer must check the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document. In the event of discrepancies (packages missing with respect to what is declared on the delivery note, opened packages, damaged packages, etc.), the same must be reported on the accompanying document with the wording "CONTROL RESERVE" and within 24 hours by fax or e-mail to direzione@eurotelitaliasrl.it.
Product deliveries will take place on all working days. As an indication, without this entailing any constraints for Eurotelitalia Srl and subject to the availability of the products on the market as well as any force majeure events, the goods will be entrusted to the courier within 24 hours of receipt of the credit note. An exception will be made for foreign countries, where an additional 24 hours will be required to organise shipments with international carriers. Delivery times will be indicated by the couriers on their company portals where it is possible to check the tracking of shipments with the tracking number which will be communicated by Eurotelitalia Srl. Delivery times are in any case to be considered valid if there are no physical or structural impediments (e.g. incorrect addresses or force majeure events). The transport fee is to be added to the price of the products purchased.

Art.7 Customer Obligations
The Customer undertakes and is obliged, once the "on-line" purchase procedure has been completed, to print and keep these general conditions, which, moreover, he/she must have already viewed and accepted as an obligatory step in the purchase. He/she shall also print out the specifications of the product purchased, in order to fully comply with the condition set forth in Articles 52 and 53 of Legislative Decree 205/06. It is forbidden for the Customer to enter false, invented or fictitious data in the registration procedure required to activate the procedure for the execution of this contract and the relative further communications; the personal data and e-mail address must be exclusively his own real data. It is expressly forbidden to enter data of third parties. The Seller reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers. The Customer indemnifies the Seller from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the Customer, as he/she is solely responsible for their correct entry..

Art.8 Complaints and shipping delays
The Customer is entitled to communicate any problems (delivery errors, misunderstandings or delays in delivery) in writing to the e-mail address direzione@eurotelitaliasrl.it. Such communications will be treated with the utmost urgency in order to resolve the inconvenience caused and pursue total Customer satisfaction. Eurotelitalia Srl shall not be liable for any damage or loss, direct or indirect, arising from delayed or non-delivery of the product.

Art.9 Right of withdrawal
As provided for by the regulations in force (Legislative Decree No. 185 of 22/05/1999 and Legislative Decree No. 206/2005), if the customer is a consumer (i.e. a natural person purchasing the goods for purposes not related to his or her professional activity), he or she may exercise the right of withdrawal within 10 (ten) working days from receipt of the goods, by sending a communication by registered letter and also to the following e-mail address direzione@eurotelitaliasrl.it
The Customer shall also return the goods no later than the fifteenth day following receipt of the product by direct delivery and forwarding the product to Eurotelitalia Srl Via Napoli, 157 (Sopercom Centre), 80013 Casalnuovo di Napoli (NA) - Italy. The Customer has the right to withdraw without penalty.
The costs of returning the product shall be borne by the Customer. For the sake of fairness, the Customer undertakes to keep and guard with the utmost care and diligence the products received and for which he intends to exercise the right of withdrawal, keeping them intact together with the original packaging complete with the original documentation of the goods and the tax documentation received with the goods themselves. The costs and risks of transport for the return shall be borne entirely by the Customer and, therefore, the Seller shall not be liable for any loss, damage due to poor packaging, or delay in delivery to its warehouse. The return of products that are not intact, deteriorated or damaged shall not be accepted by the Seller and shall be returned to the sender with additional transport costs. Once the Vendor has received the goods in accordance with the above and has carried out the necessary checks, it shall proceed to refund the Customer net of the shipping costs incurred, minus any costs relating to the return incurred by the Vendor.
If the procedure has been carried out correctly, an e-mail will be sent to the Customer indicating that the return has been accepted and, therefore, a refund will be made by bank transfer according to the data (IBAN) provided by the Customer. If, on the other hand, the above-mentioned conditions are not met, the products will be returned to the Customer's address and at the Customer's sole expense. In this circumstance, it will not be possible to refuse the shipment sent.

Art.10 Guarantees given by the client
The Customer guarantees, assuming all responsibility and holding the Seller harmless from any prejudicial consequences, that his data, provided upon acceptance of these general conditions, are true and allow the true identity of the Customer to be identified. The Customer also undertakes to immediately inform the Seller in writing, also by e-mail, of any variation in the data provided. The Customer is also informed of the need to communicate to the Seller a valid e-mail address in order to allow the latter to forward order confirmations and any possible communication.

Art.11 Limitations of liability
The Seller declines all liability for malfunctions, service interruptions, degradation of performance, whether or not due to force majeure or fortuitous events, when not directly attributable to the Seller itself due to its willful misconduct or gross negligence. The Seller shall not be liable to any party or third party for damages, losses and costs incurred as a result of the non-performance of the contract due to the aforementioned causes, the Customer only having the right to a refund of the price paid.

Art.12 Validity of Notices
The Customer accepts that notifications and communications concerning all on-line services (including those relating to purchase orders) shall be made by the Seller in electronic format by e-mail (electronic mail) and via web service, acknowledges their full validity, and expressly waives as of now the right to disavow the content of statements sent and/or received in electronic format.

Art.13 Resolutive clause
The obligations assumed by the Customer, as well as the guarantee of the successful completion of the payment used by the Customer, have an essential character. Failure by the Customer to comply with only one of these obligations, will result in the legal termination of the contract under Article 1456 of the Civil Code, without the need for judicial pronouncement, without prejudice to the right of the Seller to take legal action for damages.

Art.14 Privacy
The data will be processed, also through the creation and management of a central archive, with paper, computer and telematic supports to which only specialised and authorised personnel have access. The provision of personal data essential for the fulfilment of legal obligations and/or the establishment and/or continuation of the contractual relationship is compulsory, in the sense that in the absence thereof it will be impossible to establish and/or continue such relationship. The provision of other personal data is optional and generally functional to provide a better service to customers; any refusal to provide such data will have no negative consequences for the customer.
Pursuant to Article 13 of Legislative Decree no. 196 of 30.06.2003 (Privacy Code) we inform the Customer of the following. The Customer's personal data will be used for (i) purposes functional to the fulfilment of fiscal, accounting and legal obligations and for contract and customer management purposes (supply of products and accessories, assistance service, replacement, repair, customer management and administration, orders, shipments, invoices, solvency control and litigation management) and for (ii) purposes related to commercial activities (mail order, marketing and advertising, market analysis and surveys, promotional activities, customer satisfaction surveys, competitions, events, prize games and similar, statistical analysis).
The personal data concerning the Customer may be communicated to parent companies, subsidiaries and/or affiliates of the Seller for the same purposes as above or to external service providers specialising in: i) management of software, hardware, telematic and information systems; ii)data processing and archiving activities; iii)printing, transmission, enveloping, transport and sorting of communications to customers; iv) financing services, credit recovery and financial risk detection. The Customer may always exercise the rights provided for in Article 7 of the Privacy Code. The data controller is Eurotelitalia Srl with registered office in Cassino (FR) at Via Giacomo Leopardi 4. The Customer, by telematically sending confirmation of his purchase order, acknowledges the above information and consents to the processing of the personal data provided.

Art.15 Jurisdiction and competent court
Any dispute relating to the application, execution, interpretation and breach of the purchase contracts stipulated "on-line" through the website www.eurotelitaliasrl.it is subject to Italian jurisdiction; these general conditions refer, for all that is not expressly provided for herein, to the combined Civil Code and Legislative Decree 205/06. For any dispute between the parties in connection herewith, it is agreed that the Court of Naples shall have exclusive jurisdiction, regardless of domicile or seat.
